Terms of Use

La Barrique Wine Merchants are managed by Epicurean Wine Limited.  This online shopping service is provided to you pursuant to the terms and conditions of this Terms of Use and any operating rules or policies that may be published by the Service Provider and as may be amended from time to time.

By using this service, you acknowledge that you have read, understood and agree to be bound by all of the terms and conditions contained in the agreements, and to comply with all applicable laws and regulations.  If you do not agree to these terms do not use the La Barrique website.

Age limit

You must be 18 years of age or over to order wine through La Barrique. All sales or conveyances of wine from this site are performed by licensed independent wineries or liquor merchants who under no circumstances sell or deliver to persons under 18 years of age.

User Responsibilities

By consenting to the Agreements, you agree:

(a) You are aged 18 years or over; and

(b) You are a New Zealand resident and located in New Zealand.

(c) That the Service Provider may terminate your registration for any reason at any time. Upon termination, you will cease to use the Service. You may terminate your registration by contacting La Barrique at wine@labarrique.co.nz

(d) You will represent only yourself on the Service and no other persons, living, dead, or imagined; the Service may only be used by natural persons (i.e. individuals) on their own behalf and not by or on behalf of any commercial entity unless explicitly permitted by Epicurean Wine Brokers.

(e) You will not use the Service in any manner that adversely affects the availability of its resources to or enjoyment by other users or in any manner that could damage, disable, overburden, or impair the Service Provider’s servers or networks.

(f) You are entirely responsible for providing your own access to this Service, including, but not limited to obtaining and maintaining all telephone, computer hardware and software and paying all related charges.

(g) You are entirely responsible for maintaining the security and confidentiality of your account and password and you are responsible for all activities and conduct by you or anyone else that are conducted through your account. You agree to notify the Service Provider immediately of any unauthorised use of your account or any other breach of security. The Service Provider will not be liable for any loss or damages of any kind that may arise as a result of someone else using your password or account, either with or without your knowledge; however, you may be held liable for any losses incurred by the Service Provider or another party due to someone else using your account or password.

Pricing & GST

All prices are in New Zealand dollars (NZ$) and include GST (15% Goods & Services Tax paid to the NZ Government). All prices are correct at time of publication; however we reserve the right to alter prices for any reason.

Codes, Vouchers & Coupons

The Service Provider may provide staff, members or customers with controlled access to the site via special access codes. We will also at times provide the facilities to present and redeem vouchers or coupons through the checkout system. Any Code or Coupon may only be used at the discretion of the Service Provider. The Service Provider also holds the right to terminate any Code or Coupon for any reason.

Disclaimer

The Service Provider shall not be liable to you or any third parties for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access this website. This includes viruses alleged to have been obtained from this website, your use of or reliance on this website or any of the information or materials available on this website, regardless of the type of claim or the nature of the cause of action. By your use of this website, you agree that you are using this website solely at your own risk.
